Terms and Conditions of the Online Booking Service for the website www.dday-experience.com
1. Preamble
These Terms and Conditions aim to govern the online booking of cinema sessions or alternative content (conference, show, etc.) sold by CARENTAN HISTORICAL CENTER on the website http://www.dday.experience.com. The current Ticketing service is operated by the company SARL CARENTAN HISTORICAL CENTER, a limited liability company with a capital of 600,000 €, whose registered office is located at SAINT-COME-DUMONT, 50500, 2 village de l’amont, (RCS of Coutances 481 428 928) APE 9102Z. This service allows internet users (hereinafter referred to as “Clients”) of the aforementioned website to receive one or more E-Reservations to access the cinema hall. These E-Reservations will only be converted into an Entry Ticket when the Client presents them at the cinema check-in point, which directly grants access to the hall.
These Terms and Conditions govern exclusively the entire relationship between CARENTAN HISTORICAL CENTER and its Clients, users of the website http://www.dday-experience.com.
These Terms and Conditions may be modified at any time by CARENTAN HISTORICAL CENTER. Any modification to the documents referenced herein will be communicated to the Client upon their first use of the D-Day Experience Cinema Site after such modification.
Any E-Reservation confirmed by the Client through the online booking service implies their prior, complete, and unreserved acceptance of these Terms and Conditions, to the exclusion of all other conditions, particularly those applicable to direct sales within the cinema.
Prior to any financial transaction, the Client expressly acknowledges having read and understood these Terms and Conditions as well as the various documents referenced therein, and accepts them without reservation, by clicking the “I accept the Terms and Conditions” button. The Client thus acknowledges having the legal capacity to enter into such an agreement or being authorized by the person who is empowered to do so.
2. Specific Terms and Conditions for Online Sales
The Client acknowledges having read the specific terms and conditions of sale applicable at the time of making the E-Reservation, as displayed on the screen (including description, price, particularities of the event, limitations) and expressly accepts them without reservation. The submission of their E-Reservation and confirmation by the Client contractually constitutes full and unconditional acceptance of the Specific Terms and Conditions applicable to the booking.
CARENANT HISTORICAL CENTER draws the Client’s attention to the importance of these General and Specific Terms and Conditions and the need for the Client to read them thoroughly before making any E-Reservation.
The Client is informed that, in accordance with Article L121-20-4 of the French Consumer Code, the services offered on the website http://www.dday-experience.com are not subject to the right of withdrawal as provided for in Articles L121-20 and following of the French Consumer Code regarding distance selling.
Consequently, the services ordered on the aforementioned website are exclusively subject to the cancellation and modification conditions set forth in these Terms and Conditions.
3. Online Booking Process
To make an online booking, the Client must follow these steps:
- Visit the website http://www.dday-experience.com.
- Choose the event, session, and number of tickets desired.
- Validate the selection and review the Terms and Conditions.
- Confirm acceptance of the conditions by checking the corresponding box.
- Proceed with the secure online payment.
4. Pricing and Payment Terms
The ticket prices are indicated in euros, including all taxes. They may vary depending on the events and promotional offers. Payment is made exclusively by credit card via a secure platform. The Client guarantees to CARENTAN HISTORICAL CENTER that they have the necessary authorizations to use the selected payment card when making the reservation.
5. Booking Confirmation
Once the payment is validated, the Client will receive a confirmation email containing a summary of the order along with the E-Reservations in the form of QR codes or unique references. It is the Client’s responsibility to verify the information provided and to retain the confirmation email.
6. Cancellation and Modification Policy
The reserved tickets are non-exchangeable and non-refundable, except in the event of cancellation of the event by CARENTAN HISTORICAL CENTER. In the event of cancellation, the Client will be informed by email and the total amount of the reservation will be refunded as soon as possible.
7. Access to the Cinema
The Client must present themselves at the cinema check-in point with their E-Reservation either in printed form or on a mobile device. Any invalid or duplicate ticket may result in a refusal of access without compensation or refund.
8. Protection of Personal Data
The personal data collected during the booking process is used solely for processing orders and communications related to the service. They are neither sold nor shared with third parties. The Client has the right to access, modify, and delete their data by contacting the customer service via the email address provided on the website.
9. Liability
CARENANT HISTORICAL CENTER disclaims any liability in the event of non-performance or poor performance of contractual obligations attributable to the Client or due to a case of force majeure. The company strives to ensure the availability and security of the online booking service but cannot be held liable for any technical or computer malfunctions.
10. Disputes and Applicable Law
These Terms and Conditions are governed by French law. In the event of a dispute, the Client agrees to seek an amicable solution before initiating any legal proceedings. In the absence of an agreement, any dispute will be brought before the competent courts of Coutances.
